Is surrogacy legal in India?
Yes, commercial surrogacy is legal in India but it is almost completely uncontrolled due to not having adequate laws in relation to it.
The Indian Council of Medical Research (ICMR) has set some guidelines to prevent uncontrolled uses of surrogacy.
Accordingly, the surrogate mother has to enter into a contract with the childless parents, but there is no provision regarding the consequences in case of breach of contract.

  1. “Surrogacy arrangement shall be on contractual basis between the two parties, wherein the consent of the surrogate mother in relation to the conception, consent of the woman’s husband and other family members, medical procedure related to artificial insemination, all expenses incurred during the pregnancy All facts will be mentioned regarding compensation, consent by the surrogate mother to give the child to the couple who want to have children. But such arrangements cannot be made for commercial purposes.
  2. The surrogacy system should provide financial assistance to the couple who become parents before the birth of the child or in the event of death of one of them or divorce in them and in the event of a desire not to have a child. .
  3. Surrogacy contract requires the life insurance of the surrogate mother.
  4. At least one of the couples wishing to become a parent should be a donor, because having a biological relationship with the child will naturally fall in love with him and reduce the likelihood of various types of childbearing. If a person desiring a child is not leading a married life, he should become a donor for a surrogate child. Otherwise, they should adopt the option of adopting the child instead of surrogacy. In such a situation the biological parents and adoptive parents differ.
  5. The surrogate child belongs to a legally inclined parent, and they do not even need to have a declaration written by the parent giving birth or adoption.
  6. The birth certificate of the surrogate child should have the name of the couple wishing to become a parent.
  7. Donor’s and surrogacy’s right to privacy should be taken care of.
  8. Sex-selective surrogacy should be prohibited.
  9. Abortion cases must be governed by the Medical Abortion Act 1971.
